Crypto, Spain, and the €50k Rule: Surviving Modelo 721

Whether you’re a crypto-savvy freelancer or a remote worker with a digital nest egg, living in Spain comes with a few "surprises" in the form of tax forms. One of the newest (and most misunderstood) is Modelo 721.

If you’re a digital nomad in Spain, you need to know if you’re on the Hook. Hint: It’s not about how much you earned this year, but what you’re holding abroad.

What is Modelo 721?

Unlike your standard tax return, Modelo 721 is purely informative. You aren't paying a cent when you file it. Instead, you are telling the Spanish Tax Agency (Hacienda) about the cryptocurrencies you hold in platforms or wallets located outside of Spain.

Think of it as a "digital census" for your crypto.

Who is Required to File?

Not every nomad needs to worry about this. You only fall into the "Must File" category if you meet all three of these conditions:

  1. You are a Spanish Tax Resident: Generally, if you spend more than 183 days in Spain during a calendar year, you’re a resident for tax purposes.
  2. You Hold Crypto Abroad: This applies to assets held on foreign exchanges (like Binance, Coinbase, or Kraken) or with any custodian that doesn’t have a tax residence in Spain.
  3. The €50,000 Threshold: The total value of your foreign-held crypto must exceed €50,000 as of December 31st.

Important Note: If your total crypto value is €50,001, you must declare every asset in that group, even the ones worth only a few euros.

What Do You NOT Need to Declare?

  • Self-Custody (Cold Wallets): If you hold your private keys on a Ledger or Trezor and they aren't "custodied" by a third party, they are currently excluded from Modelo 721.
  • Spanish Exchanges: If you use a platform based in Spain that already reports to Hacienda, you don’t need to double-report it here.
  • Under €50k: If your total bag is worth €49,999 on New Year's Eve, you're in the clear.

Pre-Move Tip #1: Location is Everything

Before you move, take a look at where your crypto is sitting.

  • Spanish Exchanges: If you use a platform registered in Spain (like Bit2Me), they handle the reporting. You have no obligation to file Modelo 721 for those funds.
  • Foreign Exchanges: If you use Binance, Coinbase, or Kraken, the burden is on you to report if you cross the €50k mark.
  • Cold Wallets: Moving your funds to a Ledger or Trezor before you become a resident effectively "hides" them from Modelo 721 (though not from Wealth Tax or Capital Gains).

Pre-Move Tip #2: Holding vs. Selling

Don't confuse "reporting" with "paying."

  • Modelo 721 is just a "hello, I have this much" to the government. You pay €0 when you file it.
  • Capital Gains: Even if you aren't required to file the 721 (because you're under the €50k limit or using a cold wallet), you must pay tax on any profits the moment you sell or trade one coin for another.

The "Combined Total" Rule (The 50k Trap)

The €50,000 threshold isn't per coin; it's the sum of everything you hold abroad.

Example: On Dec 31st, you have:

  • Bitcoin: €45,000
  • Ethereum: €2,000
  • USDT: €2,000
  • Solana: €2,000

Even though your Bitcoin is under the limit, your combined total is €51,000. This triggers the obligation to report every single coin on that list.

Deadlines & Penalties

Although this is an informative statement, the sanctions exist, such as: 

  • €300 if you do not submit it when required to do so. 
  • €150 for incorrect submission.
  • €20 for each omitted piece of information (minimum €300, maximum €20.000)
